Foreclosure Defense Attorney in Miami

What Is Foreclosure?

Foreclosure is the legal right and the process by which a mortgage holder or a third-party lien-holder gains ownership of your property and/or the right to sell your property and use the proceeds to pay off the mortgage if the mortgage or lien is in default. This is actually a concept that has existed for many, many years. Previously, the law was set up so that a mortgage that was under default resulted in the automatic ownership of the property by the holder of the mortgage. The law has evolved over the years, so as to allow mortgagors time to pay off mortgages before their property is taken away. It is this process of taking away the mortgagor's property because of default that actually constitutes a foreclosure. Today, numerous state laws and regulations govern foreclosures in an effort to protect both the mortgagor and the holder of the mortgage from unfairness and, more importantly, fraud. Although states have their own variations, the basic premises of foreclosure law remain the same throughout the United States.
